Welcome to Curious Goat! These Terms of Service ("Terms") govern your use of the Curious Goat mobile application (the "App") operated by Curious Goat ("we," "us," or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you:

Are at least 13 years of age
Have the legal capacity to enter into these Terms
Will comply with these Terms and all applicable laws

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Curious Goat is a mobile learning application that provides:

Daily Lessons: Educational content on various topics
Quizzes: Knowledge-testing questions with explanations
Challenges: Critical thinking prompts and exercises
Learning Cards: Saved concepts for review
Gamification Features: Streaks, points, levels, and weekly goals
Premium Subscription: Enhanced features and unlimited access

3. Account Registration

3.1 Account Creation

To use the App, you must create an account by providing:

A valid email address
A password (or using Google Sign-In)
Your name

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

We are not liable for any loss resulting from unauthorized use of your account.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information and to update it as necessary.

4. Subscription and Payments

4.1 Free and Premium Tiers

The App offers:

Free Tier: Access to Fast Facts (twice per week)
Premium Subscription: Full access to all content and features

4.2 Subscription Terms

Premium subscriptions are available as:

Monthly: $4.99/month, billed every month
Annual: $49.99/year, billed once per year (save 17%)

4.3 Payment Processing

Payments are processed securely through Stripe
By subscribing, you authorize us to charge your payment method
Prices are displayed in the App and may vary by region

4.4 Automatic Renewal

Subscriptions automatically renew unless canceled
You will be charged within 24 hours before the end of your current period
You can cancel anytime through the App's subscription management

4.5 Cancellation and Refunds

You may cancel your subscription at any time
Cancellation takes effect at the end of the current billing period
No refunds are provided for partial billing periods
Refund requests for exceptional circumstances may be submitted to support@learnwithcuriousgoat.com

4.6 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will apply to the next billing cycle after notice.

5. User Conduct

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

Violate any applicable laws or regulations
Impersonate any person or entity
Share your account credentials with others
Attempt to gain unauthorized access to the App or its systems
Interfere with or disrupt the App's functionality
Reverse engineer, decompile, or disassemble the App
Use automated systems (bots, scrapers) to access the App
Copy, reproduce, or distribute App content without permission
Use the App to transmit malware or harmful code
Harass, abuse, or harm others through the App

5.3 User-Generated Content

If you submit content (such as challenge responses):

You retain ownership of your content
You grant us a license to use, display, and store your content to provide the service
You are responsible for ensuring your content does not violate others' rights

6. Intellectual Property

6.1 Our Content

The App and its content, including but not limited to:

Lessons, quizzes, and educational materials
Graphics, logos, and visual design
Software and underlying code
Trademarks and brand elements

are owned by Curious Goat or our licensors and are protected by intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

6.3 Restrictions

You may not:

Copy, modify, or distribute App content
Use App content for commercial purposes
Remove copyright or proprietary notices
Create derivative works based on App content

7. Third-Party Services

7.1 Third-Party Links

The App may contain links to third-party websites or resources. We are not responsible for:

The availability or accuracy of such resources
The content, products, or services on third-party sites
Any damage or loss caused by third-party sites

7.2 Third-Party Service Providers

We use third-party services including:

Stripe: Payment processing
Google: Authentication services
Cloud Providers: Data hosting and storage

Your use of these services is subject to their respective terms and policies.

8. Disclaimers

8.1 Educational Content

The App provides educational content for informational purposes only. We do not guarantee:

The accuracy, completeness, or timeliness of content
That content is suitable for any particular purpose
Specific learning outcomes or results

8.2 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
UNINTERRUPTED OR ERROR-FREE SERVICE

8.3 No Professional Advice

Content in the App does not constitute professional, legal, financial, medical, or other advice. Always consult qualified professionals for specific guidance.

9. Limitation of Liability

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURIOUS GOAT SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or inability to access the App
Unauthorized access to or alteration of your data
Any other damages arising from your use of the App

9.2 Cap on Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

The amount you paid us in the 12 months preceding the claim, OR
$100 USD

9.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Curious Goat and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

Deleting your account through the App settings
Contacting us at support@learnwithcuriousgoat.com

11.2 Termination by Us

We may suspend or terminate your account immediately if you:

Violate these Terms
Engage in fraudulent or illegal activity
Fail to pay subscription fees

11.3 Effect of Termination

Upon termination:

Your right to use the App ceases immediately
We may delete your account data (subject to legal retention requirements)
Provisions that should survive termination will remain in effect (including Sections 6, 8, 9, 10, 12, 13)

12. Dispute Resolution

12.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@learnwithcuriousgoat.com to attempt to resolve the matter informally within 30 days.

12.2 Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration rather than in court, except:

Either party may bring claims in small claims court
Either party may seek injunctive relief in court for intellectual property violations

12.3 Arbitration Process

Arbitration will be conducted by a mutually agreed arbitrator
The arbitration will take place in Los Angeles County, California
Each party will bear their own costs unless the arbitrator decides otherwise

12.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.

12.5 Opt-Out

You may opt out of the arbitration agreement by sending written notice to legal@learnwithcuriousgoat.com within 30 days of creating your account.

13. General Provisions

13.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

13.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Curious Goat regarding the App.

13.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

13.4 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

13.5 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

13.6 Modifications

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use after changes constitutes acceptance.

14. Apple App Store Terms

If you downloaded the App from the Apple App Store:

These Terms are between you and Curious Goat, not Apple
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for any claims related to the App
Apple is a third-party beneficiary of these Terms
